The Rhode Island foreclosure auction is not the end of the process. For lenders and servicers, it is often the beginning. Understanding what happens after the auction is essential for asset managers planning their REO disposition strategy.
Two Possible Outcomes at Auction
Outcome 1: Third-Party Buyer Purchases the Property
If a bidder at the auction offers more than the lender’s opening bid, the property is sold. The lender receives auction proceeds up to the outstanding debt and the process ends.
Outcome 2: Lender Takes Title (REO)
If no third-party bidder meets the lender’s minimum, the lender takes title. The property becomes REO and the lender is now responsible for taxes, insurance, maintenance, and eventual disposition.
What REO Managers Must Do Immediately After Auction
- Confirm clear title and record the deed
- Assign the property to a qualified local REO broker
- Order occupancy verification
- Begin cash-for-keys negotiation or eviction if occupied
- Order BPO and condition inspection
- Initiate property preservation and secure the asset
- Develop a disposition strategy (AS-IS cash sale vs. retail listing)
